Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Red Point Authority website at redpointauthority.com and related services (collectively, the “Site”), operated by Red Point Authority (“we,” “us,” or “our”), operated from Staunton, Virginia, United States. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Nature of the Site

Red Point Authority publishes opinion, commentary, analysis, and editorial content regarding politics, policy, culture, and public affairs. Unless expressly stated otherwise, content on the Site is opinion and commentary, not objective news reporting, and should not be relied upon as a complete or authoritative statement of fact.

Nothing on the Site constitutes legal, financial, investment, tax, medical, or other professional advice. You should consult qualified professionals before making decisions based on information you read here.

2. Eligibility

You must be at least 13 years of age to use the Site. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian. By using the Site, you represent that you meet these requirements.

4. Accounts, Comments, and User Content

The Site offers free reader accounts (email, username, password, and optional avatar), comments on articles, post ratings, writer feedback votes, and support tickets for verified account holders. Guest comments may be permitted on some pages using a display name you provide.

You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with operating and promoting the Site.

You represent that you own or control all rights in your User Content and that your User Content does not violate any law or third-party rights. We may moderate, filter, or remove content—including content that violates our standards or applicable law—at our discretion. We are not obligated to monitor all User Content.

Opinions expressed in User Content are those of the respective authors, not Red Point Authority.

5. Intellectual Property

The Site and its content—including text, graphics, logos, layout, design, software, and compilation of content—are owned by Red Point Authority or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may view and share links to our content for personal, non-commercial use. You may not reproduce, republish, frame, scrape, sell, or create derivative works from substantial portions of the Site without our prior written permission, except as permitted by fair use or other applicable law.

The Site may contain links to third-party websites, products, services, or advertisements. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party sites is at your own risk and subject to their terms and policies.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that content is complete, current, or free from errors or omissions. Editorial content reflects the views of identified authors and may include analysis, interpretation, and judgment.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RED POINT AUTHORITY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability will be limited to the fullest extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Red Point Authority and its owners, officers, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your User Content, or your violation of these Terms or applicable law.

10. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia and the United States, without regard to conflict-of-law principles.

Except where prohibited by law, you agree that any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Virginia, and you consent to personal jurisdiction and venue in those courts.

To the extent permitted by law, you and Red Point Authority waive any right to participate in a class action or class-wide arbitration.

11. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when they were last revised. Material changes will be posted on the Site. Continued use after changes become effective constitutes acceptance of the revised Terms.
